VacationGuard® Privacy Commitment
At VacationGuard®, we are strongly committed to protecting the privacy of visitors and users of our site and services. We would like you to understand why we ask for your personal information, how we keep your personal information confidential, and how you can inquire about the personal information we hold about you. We urge you to read our Privacy Commitment carefully.
2. Why We Ask You for Your Personal Information
We ask you for your personal information for the following purposes:
- to facilitate the provision of the products and services you request from us;
- to provide you with information and offers on our products and services that we believe may be of interest to you; and
- to comply with the law.
3. Information We Collect and How We Use It
If you choose to order products and services from us, via telephone, mail, or in person at one of our retail outlets, or from one of our Web sites you will have to provide us with certain information, including personal information. This information may include your name, phone number, mailing or e-mail address, and other information for payment purposes, to provide you with products and services or information and offers on products and services, or to comply with legal requirements. At VacationGuard®, information regarding our customers is used solely in the conduct of our business and to enable us to deliver excellent service to our customers. We limit the information we collect to only that which is required to execute a transaction, and to meet the purposes set out in this Privacy Commitment. If we wish to use your personal information for any other reason we will first obtain your consent.
4. Safe Harbor Data Privacy Notice
VacationGuard® adheres to the Safe Harbor Principles published by the U.S. Department of Commerce (the “Safe Harbor Principles”) with respect to personal information (as defined below) it receives from the European Union. If there is any conflict between the policies in this notice and the Safe Harbor Principles, the Safe Harbor Principles will govern.
This notice applies to all personal information we handle, including on-line (except as noted below), off-line, and manually processed data. For purposes of this notice, “personal information” means data that:
- is transferred from the European Union to the United States;
- is recorded in any form; and
- is about, or pertains to, a specific individual who is identified in, or is identifiable from, the data.
“Sensitive information” is a subcategory of personal information. Sensitive information is defined as personal information specifying medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, or the sex life of the individual. Sensitive information also includes personal information received from a third party where the third party treats and identifies it as sensitive.
Safe Harbor Principles Regarding Personal Information
Notice and Choice
We notify individuals about the personal information we collect from them, how we use it, and how to contact us with privacy concerns. We obtain personal information only as permitted by the Safe Harbor Principles or with the consent of the individual affected. Consent for personal information to be collected, used, and/or disclosed in certain ways may be required in order for an individual to obtain or use our services. To the extent permitted under the Safe Harbor, we reserve the right to process personal information in the course of providing professional services to our clients without the knowledge of individuals involved.
5. Collection of Your Personal or Financial Data
VacationGuard is committed to protecting personally identifiable information (PII) furnished by, or collected from, guests and plan-holders while accessing our on-line systems or personal representatives. We may have to ask you for your information so we can process your specific request(s). At no point will anyone from VacationGuard ever contact you to request your personal banking information or on-line passwords.
6. Disclosure Of and Control Over Personal Information
Your personal information is shared, to the extent permitted by law, within the VacationGuard® group of companies (that is, VacationGuard® and its parents, subsidiaries and affiliates). No personal information will be disclosed to anyone outside the VacationGuard® group of companies except:
- when you give us permission to do so;
- as permitted by law;
- when in good faith we believe the law requires it;
- under limited circumstances specifically described in this Privacy Commitment; or
- to VacationGuard®’s agents who carry out financial services functions on our behalf, such as data processing and we will require such agents to adhere to this Privacy Commitment.
7. Protection of Personal Information
We share our customer information internally in accordance with strict internal security controls to protect against unauthorized use, alteration, duplication, destruction, disclosure, loss or theft of, or unauthorized access to your personal information, in accordance with applicable privacy laws. Security is continually reviewed and enhanced as new technologies present themselves. We maintain physical, organizational and electronic security measures to protect your personal information. These include the use of secure locks on doors, restricted access to our information processing and storage areas, limited access to relevant information by authorized employees and independent contractors only (“Employees”), and through the use of passwords and pass keys. Personal information collected or displayed through a Web site is protected in transit by industry standard encryption processes. However, we cannot guarantee the security of personal information accessible on or transmitted via the Internet.
We instruct our Employees with access to your information that it is to be used only in adherence with the principles set forth in this Privacy Commitment and the laws applicable to each specific business. As a condition of employment, our Employees are required to sign a confidentiality agreement binding them to this responsibility, which remains with them even if they leave or retire from VacationGuard®. We hold all Employees fully accountable for adhering to this Privacy Commitment and the law.
We will comply with the Safe Harbor Principles with respect to disclosures of sensitive information, including, when applicable, obtaining the explicit consent of the individual prior to disclosing sensitive information to a third party or using sensitive information for purposes other than those for which it was originally collected or subsequently authorized by the individual. Transfers of information permitted under this notice, either to third parties or within VacationGuard, include the transfer of data from one jurisdiction to another, such as transfers to and from the United States of America.
7. Offers and informational updates
We may mail, e-mail, telephone, or contact you by other means to notify you of new products, services, or content meant as educational that is available as a result of your purchase of VacationGuard products, inclusive of mailings or other communications from our insurance carrier partner(s). You may decline similar future communications by following the opt-out directions included with these offers.
We do not provide, extend, sell or offer your information to any non-affiliated outside parties, unless required to do so under Disclosures & Transfers.
Cookies will customize your on-line experience with us by:
- If applicable, helping remember your user name and password for future visits so log-in is easier and faster
- Providing access to and loading of your information or screens in a faster manner, without having to sign in or authenticate each screen or request
Cookies can be disabled by you on your machine, following the instructions provided by your software platform; however, rejecting cookies will slow down and affect your ability to perform transactions perceived as customized and value-added on our web sites.
9. Keeping Your Personal Information Accurate
We are committed to maintaining the accuracy of your personal information for as long as it is being used for the purposes set out in this Privacy Commitment, and you play an active role in keeping us up-to-date. Prompt notification of any changes, for example to your address or telephone number, will help us provide you with the best possible service. Should you discover, upon review of your personal information, that amendments are required, please advise us. We will use our best efforts to advise others of any important amendments to your personal information which we may have released to them.
As a security precaution, we may request that the individual provide identifying information such as name, address, birth date, and/or social security number. In addition, we may limit or deny access to personal information where providing such access would be unreasonably burdensome or expensive in the circumstances, or as otherwise permitted by the Safe Harbor Agreement. In some circumstances, we may charge a reasonable fee, where warranted, for access to personal information.
10. Change of Privacy Commitment and Feedback
We continually monitor and strengthen our Privacy Commitment. If we decide to change our Privacy Commitment we will update this Privacy Commitment by updating those changes on our Websites.
